Pro-Series Terms and Conditions
1.0 Parties
These terms and conditions represent an agreement between Ed Hub Ltd (NZIHF) and the Purchaser (Participant).
Ed Hub Ltd is a registered New Zealand company and all pricing is in New Zealand Dollars unless otherwise stated.
1.1 Application to Purchase
The Participant seeks to access Pro-Series as offered by NZIHF from time to time and agrees to be bound by these Terms and Conditions. Pro-Series is a suite of education courses comprising online only courses, online courses with a practical workshop, and online micro-courses (small courses on a specific topic which update existing knowledge or introduce a new development area) which the Participant purchases the opportunity to access for a period of time (Access Period) by paying fees (Access Fees) and based on the terms and conditions of this agreement.
1.2 Confirmation of Purchase
On completing and submitting an online form to gain access to Pro-Series, NZIHF accepts the Participant's submission and the Participant’s purchase is deemed confirmed.
The Participant agrees that they are irrevocably liable for the payment of all Access Fees detailed in the online form they submitted.
The Participant agrees their total Access Period is to start at the time the form is submitted and end after the Access Period duration which is specified on the online form submitted. After this period the Student has no further rights under this agreement.
The Participant agrees that NZIHF, at its sole and absolute discretion, may change the number/frequency, topic/type, scheduling, location, presenter or any other variable within Pro-Series in order to reasonably meet the national demand for workshops, industry trends, participant feedback, presenter feedback, logistics requirements, or any other variable during the Access Period.
1.3 Entry requirements
The Participant confirms they meet the following entry requirements for Pro-Series;
- If English is not the Student’s first language, the Student confirms they have an IELTS (Academic) score of 5.5, with no band score lower than 5, or equivalent.
- Aged 18 years or over.
The Participant acknowledges that some Pro-Series courses involve physical activity. The Participant confirms they:
- Have an appropriate level of personal fitness to enable successful participation in the training and assessment, which can include moderate to vigorous physical activity.
- Accept the risks associated with taking part in exercise within Pro-Series workshops.
2 Cool Off Period
2.1 If the Participant wishes to request withdrawal from Pro-Series, the Participant MUST complete and submit to NZIHF the Pro-Series Withdrawal Form linked below:

2.2 If the Participant has not completed any online courses and has not attended any practical workshop, and the application to withdraw is received on or before the seventh (7th) calendar day after the date of execution of this agreement, being the date on the timestamp of submitting the online form, then the Participant's Access Fees are waived and no Fees under this agreement are payable.
2.3 If an application to withdraw is received on or after the eighth (8th) calendar day after the date of execution of this agreement, being the date on the timestamp of submitting the online form, the Participant's Access Fees are fully payable.
2.4 If the Participant has attended a workshop or completed an entire online theory course then they are not eligible for withdrawal regardless of the timing of the submission of the Pro-Series withdrawal form.
2.5 NZIHF counts the time stamp representing the time the Pro-Series Withdrawal Form was sent from the website as the date and time we receive a withdrawal request.
3 Default
3.1 A Participant may elect to pay their Access Fees by instalments as submitted on the online form. Where the Participant defaults on any due instalment, NZIHF reserves the right to cease access to Pro-Series and e-Certificates, until instalments are brought up to date by the Participant. Where NZIHF ceases access and instalments are brought up to date by the Participant the period where access was ceased is lost by the Participant, that is, NZIHF is not required to add the time lost during access denial to the Participants Access Period.
3.2 Where the Participant defaults on three consecutive instalments NZIHF can appoint an external collection agency for recovery of all Access Fees due, overdue and owing in the future. In the event NZIHF appoints an external collection agency the Participant agrees the Participant will be liable for any fees and/or charges of the external agency relating to the collection of the outstanding Access Fees and any enforcement proceedings.
4 Privacy of Information
4.1 NZIHF will collect, use, disclose, store and otherwise handle any personal information provided by the Participant in accordance with its Privacy Statement available on request from privacy@nzihf.co.nz and in accordance with its obligations under the Privacy Act 1993 as in force from time to time.
5 Assignment
5.1. NZIHF may assign or transfer its rights and obligations under this Agreement to an assignee or transferee at its discretion, and any such assignee or transferee shall be entitled to the full benefit of this Agreement to the same extent as if it were an original party in respect of the rights assigned or transferred to it.
5.2. NZIHF may disclose to a proposed assignee or transferee in clause 5.1 all or part of the information relating to the Participant which has been furnished to NZIHF in connection with this Agreement.
6 Publicity authorization
6.1 From time to time NZIHF may collect content (such as pictures, videos, audio and so on) within the Pro-Series learning environments. As a purchaser of the Pro-Series the Student acknowledges and gives permission for NZIHF to use the content collected in marketing material and promotional material in an ethical and honest way to promote the company and its products.
6.2 The Participant agrees that they give the permission in 6.1 without forgoing their rights and NZIHF’s responsibilities under the Privacy Act 1992 and that the Participant’s personal details will not be divulged to a third party in any marketing material.
7 Programme access and use
7.1 Where the presenter of any workshop judges the Participant does not have the required level of fitness or has failed to meet the pre-requisite theory standards required, the Participant can be excluded from participation acknowledging that this may affect the Participant’s ability to achieve the required outcomes within the course / learning opportunity.
7.2 The Participant will use the booking system for practical workshops and adhere to the booking rules as they are communicated by NZIHF from time to time. A Participant’s booking is confirmed (Confirmed Date) 5 days prior to the workshop delivery date. Where a Participant cannot attend a workshop for any reason whatsoever after the Confirmed Date, they are deemed to have used that workshop opportunity and cannot re-book on a later workshop of the same type.
7.3 The Participant will engage in all learning opportunities in good faith and maintain confidentiality and privacy of all information given and/or received in learning opportunities and/or through their involvement in Pro-Series.
7.4 The Participant acknowledges that in purchasing Pro-Series they have purchased one attendance only at any practical workshop of a particular type. Non-attendance by the Participant at a booked and confirmed workshop for any reason whatsoever is deemed use of the one attendance opportunity for that workshop and therefore a future workshop of the same type cannot be booked by the Participant.
7.5 NZIHF may, at its sole and absolute discretion, terminate Pro-Series at any time during the Access Period. Where NZIHF terminates Pro-Series NZIHF will refund the Participant, or waiver future instalments from the Participant, on a pro-rata basis Access Fees paid using the proportion of the Access Period that is not being delivered under this Agreement calculated as at the termination date.
7.6 NZIHF may, at its sole and absolute discretion, change the number/frequency, topic/type, content, duration, scheduling, location, presenter or any other variable within Pro-Series in order to reasonably meet the national demand for workshops, industry trends, participant feedback, presenter feedback, logistics requirements, or any other variable during the Access Period.
7.7 NZIHF issues completion e-Certificates when the Participant completes all requirements for the course. For courses with online and practical workshop requirements e-certificates are only issued when both elements are completed. The online element of the practical workshop must be completed no later than 14 calendar days after the workshop for e-Certificates to be awarded. Where the online course element is not completed the online course element is assessed as failed and the Participant will not be eligible for the e-Certificate.
7.8 e-Certificates can be used at REPs to collect the corresponding CPD points subject to the course continuing to be registered with REPs at the time of submission by the Participant.
7.9 COVID can affect the ability of a Participant to attend a practical workshop due to the requirement to self-isolate at short notice. While the Government mandate exists and prevents infected or close contacts from attending as booked, the Participant will be able to email NZIHF at unbook@nzihf.co.nz and unbook from that workshop. If the Participant emails before the scheduled day of the workshop they will be unbooked and therein deemed to have not used their single attendance entitlement. NZIHF will take the time stamp on the email received to the unbook mailbox as the time and date of the notice provided by the Participant. Should a Participant fail to notify NZIHF before the day of the practical workshop of their COVID status they will remain booked and will forfeit their single attendance entitlement if they do not attend.
8 Conduct
The Participant will take part in all group tasks in a manner that is conducive to a positive learning experience for all Participants. Furthermore, the Participant agrees to be bound by the following terms and conditions.
8.1 If, in the sole and absolute opinion of the presenter/host/facilitator, the Participant's behaviour is considered disruptive the Participant accepts they can be withdrawn from the learning environment and/or the entire Pro-Series at NZIHF’s sole and absolute discretion without being entitled in any way to a refund of Access Fees.
8.2 The Participant will submit any online / written assessment as their own work and not plagiarize from another Participant or another person’s language, thoughts, ideas or expressions.
8.3 The Participant agrees to meet all requirements under the Health and Safety at Work Act and its amendments and continue to meet those requirements throughout the Pro-Series Access Period.
8.4 The Participant will abide by the directions given by the staff member of NZIHF at all times whatever form those directions take.
8.5 The Participant agrees to take part in learning activities that may occur at sites other than the NZIHF campuses and the Participant acknowledges that when undertaking those activities the Participant will abide by the health and safety requirements in place at the time at those sites and any directions given to the Participant by any staff member and/or contractor at the site and/or by an NZIHF representative, and the Participant will conduct themselves in accordance with the health and safety act ensuring the Participant's own safety and the safety of others at all times.
9 Acceptance
Upon completing the online form the Participant acknowledges their understanding of the Agreement entered into with NZIHF and agrees that:
- the Participant warrants that the information provided by the Participant on the online form is correct;
- the course entry requirements are understood and accepted and will be met by the Participant;
- the Participant has declared any and all support needs to NZIHF at the time of enrolment and accepts that NZIHF will operate within its policies to meet any needs the Participant has declared;
- the Participant is responsible for his/her own progress and submission of work including assessments
